Notice of Delay (NOD)
28-day notice of delay served under Cl. 39.2. Captures delay trigger date, cause, anticipated impact on completion, and preservation of claim rights.
When to use this letter
Within 28 days of becoming aware of a delay event, before the EOT notice itself. The NOD preserves the right to claim; missing this window is the most common reason claims are time-barred.
What's inside
- Trigger event date and contractor's awareness date
- Cause of delay paragraph with documentary references
- Anticipated impact on critical path and milestone dates
- Statement that detailed quantification follows in EOT notice
- Preservation of claim rights and reference to Cl. 39.2 timing
